The American Recovery and Investment Act of 2009 allows solar owners to apply for a grant from the Treasury Department in lieu of the 30% Investment Tax Credit (ITC), which was passed late last year.

This means that a cash grant, equal to 30% of the cost of eligible solar projects, can be recouped by system owners. Projects must start construction in 2009 or 2010. Property that is not placed in service prior to December 31, 2010 qualifies for the grant program as long as construction begins prior to December 31, 2010 and is placed in service by January 1, 2017. Applications must be filed by October 1, 2011.

The grant will be issued within 60 days of the solar facility being placed in service or, if later, within sixty days of receiving a grant application. Other key details will be defined in the near future by the Treasury Department.

Beginning Jan 1 2009 the 30% federal tax credits for the purchase of solar electric systems
is uncapped. These credits were previously capped at $2,000. This new law dramatically
shortens the time to payback on your new solar power system.
The recent landmark legislation with the $700 billion Federal government bailout is the most significant
federal policy ever enacted for the solar industry. Now a law, solar tax credit provisions will.

# Extend for 8 years the 30% tax credit for both residential and commercial solar installations

# Eliminates the $2,000 monetary cap for residential solar electric installations, creating a true 30% credit

# Allow Alternative Minimum Tax (AMT) filers, both businesses and families, to take credit

# Authorize $800 million for clean energy generating facilities, such as, solar.

This legislation is just the beginning, as the 111th Congress will begin working on national renewable
electricity standards. We will keep you posted.
